These Terms of Service govern your use of the driving school website services provided by Hollyfax ("we", "us"). By accessing or using the site and its services, you agree to these Terms.
1. Services and booking
We provide distance/online information and site-based functionality for booking, assessment-related information, and learning program descriptions. Availability of training sessions depends on schedules and operational conditions.
When you request booking through the site, you provide contact details so we can communicate with you. The actual training start date and instructor assignment may be confirmed after we review your request.
2. Training outcomes and individual results
Driving education outcomes vary by individual factors, including attendance, practice frequency, learning pace, physical condition, and compliance with instructions. We do not guarantee any specific result (including passing exams) because outcomes depend on factors outside our control.
Any schedules, curriculum descriptions, and estimated timelines are informational and may be adjusted.
3. Scheduling changes and rescheduling
We may change training dates or times due to operational reasons (including instructor availability, weather/safety considerations, or force majeure). Where possible, we will notify you and propose alternative options.
You may request rescheduling subject to availability. Final approval is provided by us.
4. Liability limitations
To the maximum extent permitted by law, we are not liable for indirect or consequential damages, loss of profit, or any results that depend on factors outside our control.
Nothing in these Terms limits liability where it cannot be limited under mandatory Ukrainian law.
5. Electronic contracting and required pre-contract information (distance/online)
If you contract with us via the internet (distance electronic contracting), we provide required pre-contract information and present the terms for the electronic contract/offer. We ensure that you have access to the required legal/identity information and electronic terms in the checkout/order flow.
The applicable legal framework includes Закон України "Про електронну комерцію" від 03.09.2015 № 675-VIII.

6. Consumer rights and dispute/complaint path
If you are a consumer, you have the right to lodge a complaint and resolve disputes. For distance/online services, the consumer complaint/dispute path is available in accordance with Ukrainian consumer protection rules.
We address consumer complaints in good faith and within the timelines and procedure established by law.
The applicable legal framework includes Закон України "Про захист прав споживачів" від 10.06.2023 № 3153-IX.
If an e-purchaser portal route is applicable in your case, you may use that route for submitting a dispute/complaint.
7. Personal data and cookies
We process personal data that you provide through the site (including identifiers used in cookies/trackers, where applicable) only on a lawful basis. Typically, we rely on informed consent for tracking-related processing, and we provide a privacy notice describing the purposes and ways to manage your preferences.
